1. Acceptance of Terms

These Terms & Conditions form a legally binding agreement between you — whether personally or on behalf of an entity ("you") — and Stayza ("Stayza", "we", "us", or "our"), governing your access to and use of the Stayza website and Services.

By accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you must stop using the platform immediately.

These Terms should be read together with our Privacy Policy, Refund Policy, and Cookie Policy, which together govern your use of Stayza.

2. About Stayza

Stayza is an online accommodation discovery platform that helps students and travellers in Pakistan find verified hostels, shared apartments, rooms, and flats, and communicate with property owners through inquiries. Stayza is not a landlord, broker, real estate agent, or a party to any rental agreement between users.

3. Eligibility

To use Stayza, you must meet the following criteria:

  • Be at least 16 years old; users under 18 may use Stayza only with the consent and involvement of a parent or legal guardian.
  • Provide accurate, current, and complete information during registration.
  • Keep your account secure and never share your login credentials with others.
  • Use the platform only for lawful purposes and in line with these Terms.

4. User Accounts

When you create an account, you must provide information that is accurate, complete, and current at all times. Failure to do so is a breach of these Terms and may result in suspension or termination of your account.

You are responsible for all activity that happens under your account. Notify us immediately at hello@stayza.pk if you suspect any unauthorised use.

Stayza may refuse service, suspend or terminate accounts, or remove or edit content at its sole discretion where fraudulent, abusive, or policy-violating activity is suspected.

5. Student Responsibilities

Stayza is a discovery and lead-generation platform. We help you find verified accommodation and connect with owners through inquiries — we do not own the listed properties, take bookings, or collect rent. As a student or seeker, you agree to:

  • Independently verify the condition, pricing, and terms of any accommodation before paying a deposit or rent directly to an owner.
  • Never send deposits or rent to unverified owners, and always perform your own due diligence before paying.
  • Communicate honestly and respectfully with property owners.
  • Leave reviews that are genuine and based on real experiences.

6. Hostel Owner Responsibilities

If you list a property on Stayza, you are responsible for the accuracy and legality of your listing. You agree to:

  • Provide accurate, up-to-date information — pricing, amenities, availability, and photos must reflect reality.
  • Complete identity verification (including CNIC) before your listings are published.
  • Respond to student inquiries in a reasonable and timely manner.
  • Only list properties you are legally entitled to offer, and keep listings current.

Misleading, duplicate, or fraudulent listings will be removed, and repeat violations may lead to account termination.

7. Listing Verification

Some listings display a "verified" badge. Verification means certain information — such as the owner's identity and listing details — has been reviewed by Stayza, and in some cases that our team has visited the property.

Verification does not guarantee the quality, safety, legality, condition, or suitability of any property. You remain responsible for assessing a property before committing to it.

8. Listings, Content & Reviews

The platform lets you post content such as listing details, text, photos, reviews, and ratings ("Content"). You are responsible for the Content you post, including its legality, accuracy, and appropriateness.

You retain ownership of your Content, and by posting it you grant Stayza a non-exclusive licence to host, display, and promote it as part of operating the Services.

Reviews and ratings must reflect genuine, firsthand experiences. We may remove reviews or other Content that is fake, abusive, defamatory, or violates our guidelines.

10. Owner Subscriptions & Payments

Stayza does not process payments between students and owners and never collects rent on an owner's behalf. The only payments we handle are subscription fees from property owners for paid plans.

Paid plans for property owners are billed in Pakistani Rupees (PKR). The following terms apply:

  • When plans start — a subscription begins once your payment is verified and the plan is activated.
  • Billing cycle — plans are offered on monthly or annual cycles, as shown at checkout.
  • Renewal & expiry — we do not auto-charge a saved card. Near expiry we notify you, and you renew by submitting payment again. If you don't renew, the plan expires and the listing reverts to the free tier.
  • Upgrades & downgrades — you can change plans from your dashboard; downgrades take effect at the end of the current cycle.
  • Cancellation — you may stop using a paid plan at any time; it remains active until the end of the paid period.
  • Failed or unverified payments — if your proof of payment can't be verified, the plan won't activate and we'll contact you to resolve it.
  • Taxes — prices exclude any applicable taxes unless stated; you are responsible for taxes that apply to you.

EasyPaisa, JazzCash, and bank transfer.

Manual verification

Upload your proof of payment via the dashboard. Verification usually takes 24–48 business hours.

Invoices are available from your dashboard. Subscription fees are non-refundable except where stated otherwise in our Refund Policy.

11. Prohibited Activities

To keep the marketplace safe and trustworthy, the following are not allowed and may result in immediate suspension or a permanent ban:

  • Creating fake or multiple accounts, or posting duplicate listings.
  • Posting inaccurate pricing, amenities, photos, or other misleading information.
  • Writing fraudulent reviews — positive or negative.
  • Posting illegal, infringing, or harmful content — including copyright infringement, malware, hate speech, pornographic content, or spam.
  • Harassing, threatening, or discriminating against other users or staff.
  • Using bots, scrapers, or automated tools without permission.
  • Attempting to circumvent platform systems, security, or verification.

12. Intellectual Property

You own the Content you upload (such as listing details, photos, and reviews), subject to the licence you grant us to host and display it.

Stayza owns all rights to the platform itself — including the Stayza name, logo, branding, user interface, source code, AI systems, database structure, and verification badges. You may not copy, reuse, or reproduce these without our written permission.

13. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. Your use of the Service is at your sole risk.

While we verify listings where possible, Stayza cannot guarantee that all information provided by property owners is complete, current, or accurate. Always confirm details directly before making any commitment.

14. Limitation of Liability

To the fullest extent permitted by law, Stayza shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Because Stayza is a discovery platform and not a party to any rental agreement, we are not responsible for disputes between students and owners, the condition of any property, or losses arising from arrangements made through inquiries. Our total liability for any claim is limited to the amount you paid us (if any) in the 12 months before the claim.

15. Indemnification

You agree to indemnify and hold harmless Stayza, its team, and its partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the platform, your Content, or your violation of these Terms or any applicable law.

16. Force Majeure

Stayza is not liable for any failure or delay in providing the Services caused by events beyond our reasonable control, including internet or hosting failures, power outages, cyberattacks, government actions or restrictions, and natural disasters.

17. Suspension & Termination

We may suspend or terminate your account at any time, with or without notice, if you breach these Terms or engage in conduct that harms the platform or its users — including fraud, abuse, or prohibited activities. Here's what happens on termination:

  • Active subscriptions — paid plans may end without refund where termination results from your breach.
  • Listings — listings tied to a terminated account are removed from public view.
  • Reviews & messages — reviews may be retained or anonymised; messages are handled as described in our Privacy Policy.
  • Data retention — certain records are retained after closure for the limited periods set out in our Privacy Policy.
  • You may also close your account yourself at any time from your settings.

18. Changes to Terms

We may update these Terms from time to time as our platform and legal obligations evolve. The "Last updated" date above always reflects the most recent revision.

For material changes, we will notify registered users by email and/or an in-app notice before they take effect. Continued use of Stayza after changes means you accept the updated Terms.

19. Governing Law & Language

These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to its conflict-of-law provisions. Subject to applicable law, any disputes shall be subject to the jurisdiction of the courts of Islamabad, Pakistan.

These Terms are written in English. If we provide a translation, the English version prevails in the event of any conflict.

20. General Provisions

Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect.
Waiver
Our failure to enforce any provision is not a waiver of our right to enforce it later.
Entire agreement
These Terms, together with our Privacy Policy, Refund Policy, and Cookie Policy, form the entire agreement between you and Stayza regarding the Services.
